On December 9, 2021, the Government promulgates the Decree No. 111/2021/ND-CP, amending the Decree No. 43/2017/ND-CP regarding product labels, whereunder regulations on product origin are revised.
For instance, manufacturing, exporting or importing entities and individuals are free to identify and show the origin of their products according to the principles of authenticity, accuracy and compliance with the law on the origin of exported and imported goods made in Vietnam or international commitments in which Vietnam participates.
(Entities and individuals exporting goods that are not mentioned in current regulations will be governed by regulations ready to take effect).
Product origin information shown on labels is expressed in one of the following wording: “made in…”; “manufactured in…”; “manufacturing country”; “origin”; “produced by…”; “product of…” followed by the name of the country or territory manufacturing goods, or printed in accordance with the law on product origin.
(The phrase “product of…” that is not mentioned in current regulations is added to regulations ready to take effect).
If goods are of unknown origin as prescribed in clause 1 of Article 15 in the Decree No. 43/2017/ND-CP, the place where goods pass through the final stage to be complete must be shown.
Such place is expressed in one of the phrases or a mixture of the phrases expressing the completion stage as follows: “assembled in/at…”; “bottled in/at…”; “mixed in/at…”; “finished in/at…”; “packaged in/at…”; “labeled in/at…” followed by the name of the country or territory where goods pass through the final stage to be completed.
Decree No. 111/2021/ND-CP is entering into force as of February 15, 2022.
